COTTAGE TERMS & CONDITIONS
CONDITIONS OF BOOKING. Version 03.04.19
These are the terms and conditions which apply when you wish to hire our Cottages and whether you use our online reservation service or telephone booking.
Reference to ‘Daylesford’ is to Daylesford Organic Limited (registered in England with company number 3868901) whose registered office is at 19 Mossop Street, London SW3 2LY.
Note, separate terms and conditions apply for private hire of the Daylesford venues, Haybarn and general admission cookery school and workshop bookings.
These terms may change from time to time so please review them each time you wish to hire a Cottage. The terms and conditions applying shall be those in place on the date that you make your request to book.
You should read these terms carefully before you make a booking.
By making a booking you are accepting these terms and conditions and agreeing to strictly comply with them.
1.1 Bookings are required to be for a minimum stay of three nights on the weekend (arrival on a Friday) and four nights midweek (arrival on a Monday). Seven night bookings are also available either commencing on a Friday or Monday.
1.2 Please check that the details of your Reservation Request are complete and accurate before you fully submit. Daylesford will not be liable for any delay or non-performance if you provide us with incorrect information.
1.3 Daylesford will confirm our acceptance of your Reservation Request by sending you a booking confirmation email to the email address that you provide during the reservation process. The Booking is then in force. Daylesford reserves the right to refuse any Reservation Request at its discretion without reason.
1.4 You or any of your Guests must not resell or transfer your reservation (or any part of it) nor advertise, market or otherwise offer any Cottage either on its own or as part of a combined offer. Daylesford will not honour any reservations made in this way and do not accept any liability for doing so. If you are a Tour Operator and wish to book a Cottage you should contact the Daylesford team directly on 01608 731717 or firstname.lastname@example.org.
1.5 Although Daylesford will try to accommodate special requests, all Cottages are subject to availability.
1.6 We have one cottage that is suitable for use by persons with reduced mobility, The Egg Store is all on ground floor level, but please be aware it has a full size bath with an overhead shower. Please do telephone if you have specific requirements. Our staff are happy to help and give best advice..
2.1 Charges for the hire of the Cottages and any other goods and services to be provided by Daylesford include VAT (at the rate in force at the time of payment) and shall be in accordance with a scale of charges provided by Daylesford from time to time. When you make a Reservation Request you will be given a total price for the Cottage(s) and the Booking Dates you have requested. Daylesford reserves the right to review the charges from time to time but undertakes to honour all bookings at the charge quoted at the time of booking.
2.2 Daylesford requires full payment of the charges at the time of making your Reservation Request. Payment may be made by any of the following methods: Visa, Delta, Electron, Paypal, Mastercard, Eurocard, Maestro. In the event that your Reservation Request is not confirmed to a Booking a full refund will be given.
2.3 With regard to the scale of charges payable:
Low Season is considered to be January, February and November
Peak Season is considered to be Easter and Christmas (being a week either side of Easter weekend and Christmas Day) and also the week of the Cheltenham Festival and Big Feastival, all half term holidays and bank holiday weekends.
High Season is all remaining periods.
- TREATMENTS & OTHER PROVISIONS
3.1 The Charges include one treatment per adult Guest in the Bamford Haybarn Spa, such treatment being a choice from a defined list of treatment choices as set by Daylesford which will be provided to you.
3.2 The value of the treatment(s) is not refundable and not exchangeable and may not be used towards payment of any other activity upon the Daylesford estate even if you or any Guest chose not to take the treatment(s).
3.3 Daylesford will seek to ensure treatment times at the Bamford Haybarn Spa at times convenient for each Guest. On the rare occasion that an appointment is not available during the stay then the cottage team will contact you.
3.4 An itinerary will be provided upon completion of your booking.
3.5 The Charges include a welcome pack of a few items and amenities as further detailed on our Website.
- CANCELLATION & CHANGES
4.1 In the event that you cancel the Booking, Daylesford may charge a cancellation administration fee of £75 and reserves the right to further impose cancellation charges. Accordingly, if you cancel a Booking:
4.1.1 more than six weeks prior to the booking date the full amount paid by you shall be refunded (less the £75 cancellation administration charge);
4.1.2 more than 22 days but less than 6 weeks before the booking date, 50% of the full hire charge will be refundable (less the £75 cancellation administration charge);
4.1.3 less than 22 days before the booking date the full hire charge will be payable and no amount shall be refunded.
4.2 Should Daylesford receive another booking for the booking dates after cancellation by you or there are unforeseen circumstances out of your control being the reason for cancellation, all or a portion of the advance fee may be refunded to you in addition to the amounts detailed above at the absolute discretion of Daylesford.
4.3 Cancellations or alternations should be communicated to the Daylesford team directly on 01608 731 700 or email@example.com and Daylesford will do our best to accommodate your requirements subject to the cancellation charges above.
4.4 Daylesford do not operate or offer an insurance policy for cancellations. You may wish to take out your own insurance for such purposes.
- CHECK IN AND CHECK OUT
5.1 Check-in and check-out times are as follows:
Check-In – 4pm onwards (noting that the accommodation team may meet Guests between 4pm and 6pm but thereafter keys will be left securely for you to collect independently)
Departure – by 10am on the final morning of the stay
5.2 If you expect to arrive considerably late in the evening then please let the cottage team know in advance so we know when to expect you.
5.3 Access and key instructions will be provided upon completion of your booking.
5.4 You may be asked to provide proof of identity and nationality upon check-in.
- NUMBER OF GUESTS
6.1 Each Cottage has a maximum number of permitted Guests as indicated on the Website. The number of persons attending the Cottage shall not exceed the number of Guests agreed at the time of Booking.
6.2 Babies and children are welcome but are included towards the total number of Guests.
- USE OF THE COTTAGE
7.1 You shall ensure that use of the Cottage is conducted in an orderly fashion without causing a nuisance and in full compliance with any directions of Daylesford as may be made known through instructions in the welcome book or within the Cottage and estate or as you may be informed by the Daylesford team.
7.2 All fire exits and passageways shall be kept free from obstruction at all times and no fire appliances shall be removed or tampered with in any way.
7.3 Smoking (including e-cigarettes) is not permitted anywhere within the Cottage(s) but is permitted in the Cottage garden. Please dispose of cigarettes responsibly. Smoking inside of a Cottage may result in an additional charge for cleaning.
7.4 Guests are required to take all reasonable precautions to ensure that no damage occurs to the Cottage(s), its finishes, fittings, furniture, contents, any bikes or any other property at Daylesford. In the event of damage or the Cottage requiring extra cleaning beyond that reasonably expected, Daylesford may at its own option have such damage repaired or damaged items replaced or repaired or obtain extra cleaning services and charge you for the cost.
7.5 Nothing may be fixed to the floors, walls, ceilings or any other interior or exterior of the Cottage by any means (including drawing pins or blu-tak) unless agreed by the cottage team.
7.6 Daylesford and the cottage team may enter the Cottage(s) during the period of booking in the case of emergencies or other reasonable circumstances.
7.7 All linen is provided including dressing gowns and towels (although please note not bedding for travel cot). Should linen or dressing gowns be removed from the cottages Daylesford are entitled to seek reimbursement from you for the cost of the same.
7.8 Due to the cottages close proximity to one another, we kindly ask that noise in the evening is kept to a minimum, with no disturbance after 11pm.
- CAR PARKING
Each cottage is provided with a car parking space via the designated drive separate from the Farmshop car park. Please note the Farmshop car park gates are locked overnight and not opened until 8am. Parking is at your own risk.
9.1 Assistance dogs are permitted without charge.
9.2 Small to medium sized well-behaved and controlled dogs (no bigger than a Labrador) are welcome at a charge of £30 per dog per stay to a maximum of two dogs (except the Egg Store which is a maximum of one). This charge is subject to amendment from time to time.
9.3 Daylesford may at any time cancel the booking or refuse you and your Guests during the period covered by the booking the right to use the Cottage(s) hired in the event of your dog not behaving in the expected manner.
9.4 In the event that Daylesford cancels the booking or refuses the right to use the Cottage(s) pursuant to Condition 9.3 above, Daylesford shall be under no obligation or liability whatsoever to you or any guest, and neither you nor any Guest shall make any claim whatsoever against Daylesford in relation to the booking. In no event shall Daylesford be liable for consequential damages of any nature for any reason whatsoever, including but not limited to, transport costs.
- YOUR PROPERTY
10.1 Daylesford cannot accept responsibility for any of your or the Guests property and shall not be liable for any loss or damage to property brought to the Cottage or left behind including any car or other vehicle.
10.2 In the event that property is left behind on departure and these are recovered by the cottage team then we can arrange for these to be returned to you, to a UK address only, by secure signed for post at a charge of £8.
- TERMINATION BY DAYLESFORD
11.1 Daylesford may at any time cancel the Booking or refuse you and your Guests the right to use the Cottage(s) during the Booking Date(s) in the event of you or any Guest failing to perform any of the obligations contained within these terms and conditions.
11.2 In the event that Daylesford cancels the Booking or refuses the right to use pursuant to Condition 11.1 above, Daylesford shall be under no obligation or liability whatsoever to you or any Guest, and neither you nor any Guest shall make any claim whatsoever against Daylesford in relation to the Booking. Daylesford shall have no liability to make any refund of amounts paid by you in connection with the Booking.
11.3 Daylesford reserves the right to close the Cottage and to cancel or interrupt any Booking without notice and without any liability legal or otherwise to you or any person affected by such a cancellation (such as any Guest) in the event of war, riot, state of emergency, act of God, fire, flood, civil commotion or where any member of the public is at risk or thought to be at risk, strike (whether official or not), accident, failure of electricity or gas or any other service to the Cottage, however caused, or for any other reason whatsoever outside the control of Daylesford whereby Daylesford is unable to perform its obligations.
11.4 In the event that Daylesford cancels or interrupts a Booking pursuant to Condition 11.3 Daylesford shall let you know as soon as possible and Daylesford shall refund in full the amount paid by you to Daylesford for the Booking. This shall be the full liability of Daylesford in this circumstance.
11.5 For any other circumstance of termination by us Daylesford shall refund you such sums as you have paid to Daylesford for the Booking as our full liability.
11.6 In no event shall Daylesford be liable for consequential damages of any nature for any reason whatsoever, including but not limited to, transport costs.
- DATA PROTECTION
13.1 Daylesford is a working farm and accordingly you and the guests must take care when exploring the site and be mindful of farm machinery and animals.
13.2 Please stick to public footpaths.
13.3 Smoking is not permitted anywhere within indoor facilities on the estate.
13.4 If taking photographs, please be mindful of the privacy of other guests and visitors.
13.5 Please be aware that Daylesford is a working farm and a developing site. You may find reasonable activity and accompanying noise within normal working hours. However in the instance of any works taking place outside of this we will ensure to make you aware in advance of your stay.
14. BABY EQUIPMENT
Please advise in advance if you require a travel cot or high chairs, which are available at no extra charge. Bedding is not supplied for the travel cot.
- GOVERNING LAW
Please note that these Terms are governed by English law. This means a Contract for a Booking through our site and any dispute or claim arising out of or in connection with it will be governed by English law. You can bring legal proceedings in respect of the Booking in the English courts. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland. We will not file a copy of the Contract between us.
These terms and conditions shall be binding upon you and all Guests subject to any overriding provisions expressly agreed with the Daylesford team in writing.
- DEFINITIONS & Interpretation
In these terms and conditions (Conditions) the following definitions shall apply:
“Booking” means the contract for hire of the Cottage(s) for the Booking Dates between you and Daylesford which if formed following receipt by you of a booking confirmation email on behalf of Daylesford confirming acceptance and the details of your Reservation Request;
“Booking Date(s)” means the dates that you have booked for use of the Cottage(s) and as confirmed in the booking confirmation email;
“Cottage” means such cottage(s) that Daylesford may have available for hire and which you wish to hire;
“Guests” means those people staying in the Cottage(s);
“Reservation Request” means the request by You for hire of Cottage(s) for the Booking Dates which request may be made either through online reservations or via telephone booking;
“you” means the organisation, company or individual who makes a booking for hire of any Cottage(s) and being the person responsible for the Guests and ‘your’ shall be construed accordingly.
